Welcome to WhaleKub ("WhaleKub", "we", "our", or "us"). These Terms of Service govern your access to and use of the WhaleKub website, developer platform, APIs, documentation, SDKs, and related services. By creating an account or using our services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. If you use WhaleKub on behalf of a company or organization, you represent that you have authority to bind that organization.

2. Developer Account

You are responsible for maintaining your account security.
You are responsible for all API Keys issued to your account.
Do not share your credentials with unauthorized persons.
You must provide accurate registration information.

3. API Products

WhaleKub is a Developer Platform that provides access to API Products developed by WhaleKub and its affiliated brands. Each API Product may have its own pricing, documentation, rate limits, and service-specific terms.

4. Subscription

Subscriptions renew automatically unless cancelled.
Subscription fees are billed in advance.
Taxes may apply depending on your country.
Failure to pay may result in service suspension.

5. API Usage

Use APIs only as documented.
Respect rate limits and quotas.
Do not attempt to bypass security controls.
Do not abuse or overload our infrastructure.
Do not interfere with other customers.

6. Acceptable Use

You agree NOT to use WhaleKub for:

Illegal activities
Fraud
Spam
Malware
Unauthorized scraping
Circumventing platform restrictions
Reverse engineering protected services
Violating third-party intellectual property rights

7. API Keys

API Keys remain the property of WhaleKub.
You must immediately report compromised API Keys.
We may revoke API Keys that violate these Terms.

8. Intellectual Property

All software, documentation, SDKs, APIs, trademarks, logos, source code, and website content remain the exclusive property of WhaleKub unless otherwise stated. No ownership is transferred by using the Services.

9. Third-Party Services

Some API Products integrate with third-party platforms including but not limited to marketplaces, logistics providers, payment providers, or external services. Availability and functionality may change without notice.

10. Availability

We strive to provide reliable services but do not guarantee uninterrupted availability. Maintenance, upgrades, outages, or third-party failures may temporarily affect service.

11. Billing & Refunds

Subscription fees are generally non-refundable.
Refunds, if any, are governed by our Refund Policy.
Unused subscription time is not refundable.

12. Suspension & Termination

We may suspend or terminate accounts that violate these Terms, abuse our services, or create security risks without prior notice.

13. Limitation of Liability

To the maximum extent permitted by law, WhaleKub shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption.

14. Disclaimer

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.

15. Privacy

Your use of the Services is also governed by our Privacy Policy.

16. Changes

We may modify these Terms at any time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by the laws applicable to the jurisdiction where WhaleKub operates, unless otherwise required by applicable law.
